1. About AROGYOS

AROGYOS (a registered sole proprietorship based in India) is a personal data analytics software platform that enables users to upload, analyse, and track biological and clinical data including blood test reports, biomarkers, and related health parameters. AROGYOS is a Software-as-a-Service (SaaS) product. AROGYOS is not a medical device, not a diagnostic laboratory, and does not provide medical diagnoses or prescriptions.

AROGYOS partners with NABL/CAP-accredited laboratories for doorstep sample collection services available in select cities in India.

2. Eligibility

You must be at least 18 years of age to create an account and use AROGYOS independently. Persons between 13 and 17 years may use the platform only with explicit, verifiable parental or guardian consent. Persons under 13 years are not permitted to use this platform.

3. Health Data — Collection & Processing

AROGYOS collects Identity Data (name, date of birth, gender, contact details), Health Data (lab reports, biomarker values, biological age scores — classified as Sensitive Personal Data under India's DPDP Act 2023, Special Category Data under GDPR Article 9, and Protected Health Information under HIPAA), and Usage Data. Your health data is processed exclusively to compute biological age, generate AI-assisted insights, store your Health Vault history, and facilitate lab bookings, based on your explicit, informed, freely-given consent.

4. Applicable Laws & Your Rights

AROGYOS complies with India's DPDP Act 2023, IT Act 2000, and Consumer Protection Act 2019; the EU/UK GDPR; the US CCPA/CPRA; Singapore's PDPA; the UAE Federal Data Protection Law; Australia's Privacy Act 1988; and Canada's PIPEDA. To exercise any data right, email support@arogyos.com — we respond within 12 hours.

5. Data Retention

Health reports and biomarker data are retained for 7 years or until account deletion, whichever is earlier. Identity data is retained for 3 years post-closure. Payment records are retained for 8 years per Indian accounting standards. Upon verified deletion request, all data is purged within 30 days from active systems.

6. International Data Transfers

Your data is stored primarily on servers in India and replicated to secure cloud infrastructure for availability. International transfers are protected by Standard Contractual Clauses and Data Processing Agreements with all sub-processors.

7. Security

AROGYOS uses 256-bit AES encryption at rest, TLS 1.3 in transit, Content Security Policy headers, HSTS, OTP rate limiting, and automatic session expiry. In the event of a data breach affecting your rights, we notify you within 72 hours as required by GDPR Article 33.

8. Medical Disclaimer

AROGYOS is a health-education and data-tracking platform — not a licensed medical device, diagnostic laboratory, or healthcare provider. The biological age score and AI-generated insights are for informational purposes only and do not constitute medical advice. Always consult a qualified healthcare professional before changing your diet, medication, or lifestyle. In an emergency, call your local emergency services immediately.

9. Subscription & Payment

AROGYOS offers monthly and annual subscription plans, billed in INR (India) via Razorpay or USD (international) via Lemon Squeezy. Subscriptions cancelled within 7 days of first purchase, before consuming any included service, are eligible for a full refund.

10. Intellectual Property

All content, software, AI models, and brand elements of AROGYOS are its exclusive intellectual property, protected under the Copyright Act 1957 (India). Your health data belongs to you — AROGYOS claims no ownership over your personal health records.

11. Limitation of Liability

AROGYOS shall not be liable for indirect, incidental, or consequential damages arising from use of or reliance on the platform. Total cumulative liability shall not exceed subscription fees paid in the preceding 12 months.

12. Dispute Resolution & Governing Law

For Indian users, these Terms are governed by the laws of India, with disputes referred to binding arbitration under the Arbitration and Conciliation Act 1996 if unresolved through negotiation. EU/UK and US users retain their statutory consumer rights.

13. Changes to These Terms

We may update these Terms to reflect changes in law or our services, with at least 30 days' notice of material changes. The current version is always accessible at arogyos.com/terms.
